Got to love Illinois laws. Its a felony to disable a device that shouldn’t even be legal, but there are no penalties at all for wrongful booting, aside from a possible civil suit that the consumer would lose anyway.

These kind of laws need to be repealed from the books. The “theft” of services (parking on the lot) does not justify the “theft” of the use of the car. And the law should be re-written such that if the boot is wrongly applied (for example if two go into one store and two go into another), the owner of the stores connected to the lot should be subject to VERY heavy fines. If the owners really want to “protect” their lot, they should be forced to take the “normal” procedures to do this — a gate and attendant with a validation system. This is yet another example of the government ceding its enforcement authority to a private entity for the benefit of the private entity.

DoR, the point if the comment is that it can be easily done.
I didn’t mention assaulting anyone or raking the boot with. Tampering I can see but not theft and more probably a misdemeanor.

Doc…that still would be a misdemeanor or felony…depending upon the city/township municipality rules governing private booting in Gurnee.

Plus the assault of the lot attendant. Even though it was ‘just’ a shove, it qualifies.

And lets remember…booted vehicles have their plates on the paperwork.

Vehicle and/or Boot vanishes? Owner can be legally charged with Felony Theft.
